Draft updated October 2, 2026. Effective date: pending adoption. This is a proposed process for a developing hosting service. Publishing it does not establish a registered copyright agent, an operational takedown program or eligibility for a statutory safe harbor.
Current contact and agent status
Send concerns to legal@digifender.com. Digifender's company contact page states that no DMCA designated-agent registration has been filed for Digifender LLC. The contact below is a reporting contact, not a representation that the required designation for OpenHost has been completed. A business registered agent is not automatically a copyright agent.
Before relying on the US Digital Millennium Copyright Act notice-and-takedown framework, Digifender must confirm the applicable service category, complete any required agent designation, publish matching contact details and operate the required procedures. The US Copyright Office overview explains those conditions; 17 USC Section 512 supplies the statutory requirements.
Copyright reports
A copyright owner or authorized representative can report a concern using the legal mailbox. A formal notice should identify the protected work, the allegedly infringing material and enough location information to find it; provide contact information and a signature; and contain the required statements of good-faith belief, accuracy and authority. Consider licenses, fair use and other lawful permissions before submitting a claim.
Use the Copyright Office's official notice guidance for the required statements. Knowingly making a material misrepresentation can have legal consequences. A report should identify actual material or activity rather than ask us to remove an entire unrelated service.
Proposed handling and counter-notices
The proposed process would assess a sufficiently detailed notice, act expeditiously where the applicable framework requires it, and notify the affected customer where appropriate. Missing information may require clarification. A complaint alone is not a final legal determination of infringement.
A customer who believes material was removed by mistake or misidentification may submit a counter-notice. It must identify the removed material and former location, include a signature and contact information, and provide the required sworn good-faith statement, jurisdiction consent and agreement to accept service. A counter-notice can expose the sender to litigation; consult the official guidance before submitting one.
Under the Section 512 counter-notice procedure, the proposed process would send the counter-notice to the original claimant and restore qualifying material within 10 to 14 business days after receipt unless notified of a filed court action seeking to restrain the infringement. An independent lawful reason to restrict a service must be explained separately. This statutory framework is not a promise that OpenHost has already established every condition for it.
Repeated infringement and other abuse
Before launch, Digifender must adopt and reasonably implement an appropriate repeat-infringer policy, accommodate applicable standard technical measures and train staff to assess reports and disputes. Repeated infringement may result in account termination under the adopted policy. A disputed or mistaken allegation should not automatically be counted as an established violation.
Non-copyright concerns, including phishing, malware, impersonation and privacy abuse, can use the same mailbox under the Acceptable Use Policy. You do not need to own copyright to report another type of harm.
Information sharing and contact
Reports, counter-notices and relevant identifying information may need to be shared with the other party, necessary providers, advisers or authorities for investigation, the applicable legal process or a legal obligation. Send only relevant information. Do not attach illegal imagery, malware, secrets or unnecessary sensitive records. The Privacy Policy describes the proposed handling of these records.
